Cease and desist

The power of the legislature to make retrospective changes in laws is generally accepted despite many misgivings. Unfortunately the legal sanction to such moves has led to its widespread misuse, especially by the ministry of finance which has sought to use the provisions to nullify or even overturn many judicial decisions by introducing clarificatory amendments in the Income Tax Act.
