Hazards of taking on Khaps from the judicial pulpit

Are Khap panchayats illegal? Or, are they simply not allowed to do illegal things? Justice Katju's judgment in the Tamil Nadu Arumugam Servai case has won great media notoriety by declaring Khap panchayats 'barbaric' and 'shameful'. Is this really the case? In fact, the case in question had nothing to do with Khaps and arose out of a member of 'Servai' backward caste abusing and beating up two 'Palan' scheduled caste members at a temple festival and saying they were "Pallapayal and eating deadly cow beef".
